Defective Products

East Tennessee Product Liability Attorneys

The Hurley Law Firm, P.C. has successfully sued major manufacturers for injuries or deaths caused by a defective product. These are complex, hard-fought cases requiring extensive research, expert testimony and excellent courtroom skills.

The average consumer or worker injured by a defective product would not get far in bringing a claim for damages. With over 20 years of trial experience, D. Scott Hurley has the ability and resources to bring these cases. He has held big companies and their insurance carriers accountable for bad product designs, manufacturing flaws or failures to warn end users of foreseeable harm.

Contact our Knoxville office for a free case evaluation. We have represented clients across East Tennessee in a variety of defective product cases:

  • Stump grinders — Our advocacy and success at trial led to safety changes in the manufacture of these machines.
  • Riding lawnmowers — The technology has long been available to disengage mower blades when the machine is going in reverse. We have collected damages for a number of small children have been killed or maimed by this safety lapse. Some mower manufacturers have resisted change and many older mowers are still out there.
  • Heavy equipment — We represented a worker who was 40 feet in the air when the boom cylinder on a bucket truck ("cherry picker") failed. He suffered a ruptured spleen and other injuries which kept him from working for two years. We obtained a large settlement from the manufacturer. In another case, we sued the maker of a loader for brake failure led to severe injury when he was thrown from the vehicle at impact.
  • Pre-engineered metal buildings — We represented four construction workers who suffered permanent injuries when the large metal structure they were building collapsed in high wind. Mr. Hurley persevered for four years in a very complex lawsuit to secure a fair settlement.

We will examine any defective product case, including power tools, machines, implements or vehicles, or consumer products such as ladders or unsafe toys. D. Scott Hurley has the knowledge and experience to determine if you have a viable case. He has led seminars on preparing and trying product liability cases and is often sought by other lawyers to take on especially challenging litigation.
